Court of Appeals for the Federal Circuit reverses or vacates the Delaware District Court's judgment on the '439, '440 and '015 patents in Exelixis, Inc. v. MSN Laboratories Private Ltd., Fed. No. 2025-1236 (argued 4 June 2026, opinion pending), removing the 15 January 2030 floor on generic CABOMETYX entry. MSN has already stipulated to infringement (order of 21 June 2022), so the appeal turns purely on invalidity and a reversal does not remand into another infringement trial. The '349 patent (expiring 2032) was held valid but not INFRINGED by MSN's product and protects nothing against this filer.
